1. About BeforeListed™

BeforeListed™ is a real estate marketing and intake website operated by Tuval Mor, a licensed real estate agent affiliated with Corcoran, to collect renter inquiries and support proactive rental outreach beyond publicly advertised listing platforms.

BeforeListed™ does not own, manage, or operate any real property.

2. Role of the Website

The website is used to:

• Collect renter inquiries.
• Facilitate initial contact between renters and a licensed real estate agent for the purpose of initiating potential representation, subject to the execution of required agency disclosures and fee agreements.

The website itself does not create an agency relationship. Agency representation is established only upon execution of the required agency disclosure and fee agreement provided by the agent’s brokerage, which may be made available electronically.

Information provided through the website is for general informational purposes only and does not constitute legal or housing advice.

3. Brokerage Services

All real estate brokerage services — including representation, disclosures, negotiations, and fee arrangements — are provided solely by the licensed real estate agent and their sponsoring brokerage.

BeforeListed™ does not act as a real estate broker and does not independently represent renters or landlords.

4. Referrals and Collaboration

If appropriate, the representing agent may introduce another licensed real estate agent to assist with a renter’s search. Any such involvement will be disclosed to the renter, and required agency disclosures will be provided in accordance with applicable law.

BeforeListed™ does not assign agents, coordinate representation, or require collaboration.

5. No Guarantees

Submitting a request through BeforeListed™ does not guarantee:

• contact from an agent,
• identification of an available apartment,
• access to any property, or
• approval by an owner or management company.

Availability, pricing, and lease terms are determined solely by property owners and are subject to change.

Agents are not obligated to continue searching, provide updates, or re-contact users unless and until an agency relationship is formally established.

BeforeListed™ does not monitor, verify, or confirm the marketing status, availability, or accuracy of information provided by agents, owners, or property managers.

At the time an agent responds to a renter’s request, any potential opportunity identified is based on information available at that time and may not be publicly advertised. Properties may subsequently become publicly advertised, modified, or withdrawn at the owner’s discretion and without notice.

6. Fees

BeforeListed™ does not charge renters any fees.

Any broker fee is determined solely by the licensed real estate agent and/or their brokerage and is payable only if the renter leases an apartment presented by that agent, pursuant to the applicable agency and fee agreements.

7. User Responsibilities

Users agree to:

• provide accurate and truthful information,
• comply with all Fair Housing and anti-discrimination laws, and
• use the website only for legitimate rental inquiries.

Discriminatory, abusive, or fraudulent conduct is prohibited.

8. Fair Housing Compliance

All services and communications facilitated through BeforeListed™ are subject to:

• the Federal Fair Housing Act,
• the New York State Human Rights Law, and
• the New York City Human Rights Law.

Discrimination based on any protected characteristic, including lawful source of income, is strictly prohibited.

9. Neutral Display and Review of Renter Submissions

BeforeListed™ displays renter submissions to participating agents strictly in chronological order, with the most recently submitted requests appearing first. The website does not score, rank, filter, or otherwise prioritize renter submissions based on voucher status, source of income, household composition, demographics, or any other personal characteristics.

BeforeListed™ does not collect income, voucher, or subsidy information within the renter request form. Any such information voluntarily provided by a renter outside the form, including by email or message, is not used by the website to influence the display, ordering, visibility of renter submissions.

Any sorting, filtering, or review practices are performed solely by individual agents at their own discretion. BeforeListed™ does not direct, control, influence, or supervise the order in which an agent reviews, contacts, or evaluates renter submissions. BeforeListed™ operates as a neutral marketing and intake website and is not responsible for an agent’s independent decision-making process.

BeforeListed™ does not review, validate, or endorse representations made by licensed agents, owners, or third parties.

BeforeListed™ does not supervise, review, or approve an agent’s communications or decisions.

10. Limitation of Liability

To the fullest extent permitted by law, BeforeListed™ is not liable for indirect, incidental, special, or consequential damages arising from the use of the website or interactions with third parties.

Your sole remedy for dissatisfaction is to discontinue use of the website.

11. Indemnification

Users agree to indemnify and hold BeforeListed™ harmless from claims arising out of:

• misuse of the website,
• violations of these Terms, or
• interactions with agents, owners, or third parties.

12. Governing Law

These Terms are governed by the laws of the State of New York.

13. Modifications

BeforeListed™ may update these Terms from time to time. Continued use of the website constitutes acceptance of the revised Terms.
